I. Scope of the Agreement
1.1 This Nova Sling User Agreement (hereinafter referred to as the "Agreement") is a legally binding agreement between you (hereinafter referred to as the "User") and the developer of the game (hereinafter referred to as "we," "us," or the "Developer") regarding your download, installation, and use of Nova Sling (hereinafter referred to as the "Game") and related services.
1.2 By downloading, installing, or first launching the Game through application stores (including but not limited to Apple App Store and Google Play), you acknowledge that you have fully read, understood, and agreed to all terms of this Agreement and the attached Privacy Policy.
1.3 If you do not agree to any provision of this Agreement, you must immediately cease using the Game. If platform rules or applicable laws require you to confirm acceptance of an updated Agreement before continuing to use the services, you must complete such confirmation in a timely manner; otherwise, you may not be able to continue using certain features.
1.4 We reserve the right to amend or update this Agreement from time to time as necessary. The revised Agreement shall take effect upon publication within the Game or on the official website. You are advised to review it periodically to stay informed of the latest version.
1.5 To maintain proper operation and service quality, we reserve the right to modify, suspend, or terminate all or part of the services when necessary, and to independently decide whether to restrict or terminate your access to the Game without prior notice.
II. Access to and Use of the Services
2.1 You are responsible for any network communication fees and equipment costs incurred in accessing or using the services.
2.2 By using the services, you confirm that you are at least 13 years old. If you are between 13 and 18 years old, you must use the services only with the consent of your legal guardian, who has read and agreed to this Agreement.
2.3 Any risks and liabilities arising from downloading, installing, or using the Game shall be borne solely by you.
III. Account and Data Management
3.1 The Game is a casual game that does not require account registration to play.
3.2 Game data is primarily stored locally on your device. Uninstalling the application, clearing cache data, or changing devices may result in loss of game progress. To the maximum extent permitted by law, we shall not be liable for any losses arising from such circumstances.
3.3 iCloud Backup (iOS devices only): You may choose to back up your game data using Apple's iCloud service. This service is independently operated by Apple, and its data processing activities are governed by Apple's iCloud terms and privacy policy.
IV. Fees and Virtual Items
4.1 In-game virtual currency (such as coins or gems) may only be obtained through official channels. We reserve the right to remove or delete any virtual items or currency obtained through unauthorized, improper, or illegal means without prior notice.
4.2 Virtual currency and items are for in-game use only and may not be exchanged for real-world currency or tangible goods, nor transferred, traded, or used for commercial purposes in any form.
4.3 Upon reasonable notice (including but not limited to in-game announcements or official website notices), we reserve the right to adjust the types, prices, functions, or acquisition methods of virtual currency or items.
V. User Conduct
5.1 During your use of the services, you must not infringe upon the lawful rights and interests of any third party and must comply with all applicable laws and regulations.
5.2 You are required to adhere to public order, moral standards, and online conduct rules. If you violate this Agreement, we may take measures including but not limited to issuing warnings, restricting features, or suspending access.
5.3 Any cheating or actions that undermine the fairness of the Game are strictly prohibited, including but not limited to using unauthorized software, exploiting vulnerabilities, interfering with server operations, or infringing intellectual property rights.
VI. Intellectual Property
6.1 All intellectual property rights related to the Game and its content (including but not limited to source code, object code, documentation, artwork, character designs, interface layouts, sound effects, and trademarks) belong to the Developer. Without prior written authorization, no individual or entity may copy, distribute, modify, or use such content for any purpose.
VII. Disclaimer
7.1 The Game is provided on an "as is" and "as available" basis. We make no express or implied warranties regarding the suitability, stability, continuity, or non-infringement of the services.
7.2 We shall not be liable for any direct or indirect losses resulting from force majeure events, third-party service interruptions, network failures, or your improper use of the Game.
VIII. Limitation of Liability
8.1 To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, punitive, or consequential damages arising from your use of or inability to use the services, including but not limited to data loss, loss of profits, or business interruption.
IX. Governing Law and Dispute Resolution
9.1 The formation, effectiveness, interpretation, performance, and dispute resolution of this Agreement shall be governed by the laws of the People's Republic of China (excluding conflict of law rules).
X. Severability
10.1 If any provision of this Agreement is held invalid or unenforceable by a court of competent jurisdiction, such provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
XI. Assignment
11.1 We reserve the right to assign our rights and obligations under this Agreement to an affiliate or successor entity in the event of acquisition without your prior consent. You may not assign any of your rights or obligations under this Agreement without our prior written consent.
